Terms and conditions

You and Your Fundraising Activity

1. I acknowledge that I am organising a fundraising activity (“the Activity”) as an independent supporter of the Alzheimer’s Society Ltd (a company registered in England and Wales) with company number: 2115499 and charity number: 296645 (“the Alzheimer’s Society”). 

2.  I understand that, in organising the Activity, I am organising it at my own risk and in my capacity as an independent supporter of the Alzheimer’s Society only. 

3. I confirm that I am at least 18 years of age.

 
Your obligations 

4.    I take full responsibility for organising the Activity and will ensure that the Activity is undertaken in accordance with all applicable laws (including, without limitation, all applicable health and safety laws, the Data Protection Act 2018 and all other relevant data protection legislation and regulations, and the Code of Fundraising Practice maintained by the Fundraising Regulator).

5.    I agree to:

     a.    obtain all necessary licenses or permissions required to undertake the Activity at my own cost; 

     b.    comply with the Alzheimer’s Society fundraiser’s code of practice whilst undertaking the Activity and fundraising in aid of the Alzheimer’s Society; 

     c.    not hold the Alzheimer’s Society, its employees, officers or agents responsible for any injury, loss or harm resulting from me organising the Activity; and 

    d.    refer to raising money “in aid of” the Alzheimer’s Society rather than on behalf of the Alzheimer’s Society.  

6.    I also agree to not do anything to bring the name of the Alzheimer’s Society into disrepute, or otherwise damage the name or reputation of the Alzheimer’s Society. 

7.    I acknowledge that, in the event that the Alzheimer’s Society reasonably believes that the Activity may damage the Alzheimer’s Society’s name or reputation, the Alzheimer’s Society has the right to ask me to cease undertaking the Activity immediately and I will comply with such request.  


Costs

8.    I acknowledge that I am responsible for all costs and expenses incurred as a result of or arising in connection with the Activity.


Donations to the Alzheimer’s Society 


9.    I agree to pay all proceeds raised from the Activity to the Alzheimer’s Society as soon as reasonably practicable and in any event, no less than 12 weeks after the date on which the Activity took place. 

10.    All payments made by me to the Alzheimer’s Society may be made via debit or credit card, cheque, bank transfer to such account as notified to me in advance or via a secure online fundraising page 

11.    I agree to encourage donors to make gift aid declarations where eligible, which may enable Alzheimer’s Society to recover basic rate tax on the donations with the form of such declarations to be notified to me by the Alzheimer’s Society in advance (if applicable). 


Materials and information

12.    I agree that any materials, documents or information (in whatever form) supplied by the Alzheimer’s Society to me for the purpose of the Activity will only be used by me in connection with the Activity. 

13.    I acknowledge that the Alzheimer’s Society owns all intellectual property rights in such materials, documents or information and I will not (and will not allow any third party to) have the benefit of that material or information without first obtaining the Alzheimer’s Society’s written consent. 


Personal Data and Photographs

14.    I agree that the Alzheimer's Society may use my contact details to contact me about the Activity.  

15.    All personal data held by the Alzheimer’s Society will be handled in accordance with applicable data protection laws and the Alzheimer’s Society privacy statement which can be found at https://www.alzheimers.org.uk/legal-information/personal-data.

16.    I agree that if I share any images taken at my event with Alzheimer’s Society, I will make sure the people in photos and videos are aware I have done so.  


Alzheimer’s Society’s Liability and Indemnity

17.    Subject to paragraph 18 of these terms and conditions and the law, the Alzheimer’s Society excludes all liability arising in connection with the Activity. 

18.    Nothing in these terms and conditions shall limit or exclude the Alzheimer's Society's liability in respect of death or personal injury sustained as a direct result of the negligence, breach of statutory duty or fraudulent misrepresentation of the Alzheimer's Society, its employees or agents.

19.    I agree to indemnify the Alzheimer’s Society, its employees, officers and agents against any costs, claims, loss or liability arising as a result of the Activity or any breach of these terms and conditions.  


General

20.     The Alzheimer's Society may vary these terms and conditions from time to time and any update to these terms shall be made available on the Alzheimer’s Society website

21.    These terms and conditions and any dispute or claim that arises out of or in connection with them is governed by and construed in accordance with English law.  The English courts have exclusive jurisdiction to settle any dispute or claim that may arise out of or in connection with these terms and conditions.

Terms and conditions for Quit for a bit Prize incentive

1.    No purchase necessary. There is no obligation to make a donation to be eligible for entry.

2.    Subject to these terms and conditions, you can enter without making a donation by sending your name and address on a postcard to: Quit for a bit Magnet Mailing, Scott Lodge, Scott Rd, Plymouth PL2 3DU.

3.    Entry is open to UK residents over 16 years of age.

4.    Maximum 1 entry per person. Participants must have supplied a full postal address to participate.

5.    Entry signifies acceptance of these rules. Entries not submitted in accordance with the rules and illegible, incomplete or altered entries will be disqualified and Alzheimer’s Society reserves the right to withhold or cancel the prize in the event of non-compliance with these rules. Alzheimer’s Society decision is final and no correspondence will be entered into in relation to the competition.

6.    The incentive will be open until the 14 of November 2021.

7.    The incentive prize is a fridge magnet. There will not be any alternatives, no interest is payable and prizes are not transferable.

8.     Magnets will be available to the first 1,000 entrants. 

9.    The mailing will be posted within 28 days of the closing date.
